    Hey guys n gals,
    I need a bit of help, my collector's car was in an accident (100% other party's fault),
    I'm looking to see how I can get compensation for the depreciated value of the car as it was "clean" and will be "rebuilt".
    Icbc states they would spend $24K max on repairs, estimated cost is just 6000, actual cost unknown as it's not fixed yet.
    It's been listed for sale for $28K since before the accident. Car is maintained mostly by myself and x-mechanic and 28K value is reasonable as compared to other models on craigslist through a 2 year time period (and I have printouts of relative ads).
    Any advice or recommendations to a lawyer appreciated.

    On a side note: I do have a "light?" concussion, cannot work at the moment. Can drive short distances.
    Accident was 3 weeks ago.

    I'm sorry that happened. That is crappy.

    I've know of two acquaintances who successfully received compensation for depreciated resale value on their cars after their basic claim associated with repairing the car. I can't remember the amounts or specifics, or even which lawyer they used...but the argument is valid.

      For what it's worth - if ICBC repairs your car, it will not be a rebuilt, just have an accident on record. It is only a rebuilt when ICBC writes off your car and pays you out, and then resells it wholesale to a bodyshop who fix it, re-certify it, and register it before selling. Diminished value claims are extremely rare to succeed with, I wish you the best but it is undoubtedly an uphill battle. My recollection is that there have been a handful of cases dealing with cars worth hundreds of thousands of dollars, I don't know of any at the dollar level you are talking about.

        Can't add anything to the vehicle discussion, but if you are suffering from a concussion, you need to follow the doctor's recommendation and absolutely do as little as you can. When I was recovering from a concussion a few years ago, I was so thoroughly suprirsed by how even the most mundane task would become mentally taxing after a short while.

        Get rest -- get lots of rest, both physically and mentally. Don't think.

          Thanks Rick, yes I am experiencing the same thing...getting tired even after doing almost nothing. So yes, I try to get much rest.
